| Abstract: | Este trabalho consiste em uma análise crítica da jurisprudência do STF, em especial da sua quinta súmula vinculante, editada em maio de 2008. O enunciado, que relativiza a importância da defesa técnica no processo administrativo disciplinar, baseia-se em premissas fixadas na década de 1990 a partir do significado restritivo do princípio do contraditório e do processo justo. O atual estágio de desenvolvimento teórico do Direito Processual, alcançado pela interpretação da Constituição da República de 1988, revela a inconsistência da súmula vinculante nº 5 ante o anacronismo do raciocínio jurídico no qual ela se baseia. |
| Abstract: | This work consists of a critical analysis of the jurisprudence of the STF, in particular of its fifth binding precedent, edited in May 2008. The statement, which relativizes the importance of technical defense in the disciplinary administrative process, is based on premises established in the decade of 1990 from the restrictive meaning of the adversarial principle and the fair trial. The current stage of theoretical development of procedural law, achieved by the interpretation of the Constitution of the Republic of 1988, reveals the inconsistency of binding precedent nº 5 due to the anachronism of the legal reasoning on which it is based. |
