| Abstract: | O presente artigo visa a analisar questões jurídico-políticas que permeiam os ataques terroristas sofridos pela França em novembro de 2015, especificamente no que tange a medidas de contraterrorismo. Objetiva-se, a partir da Corte Europeia de Direitos Humanos, demonstrar de que forma ocorreu e ocorre a consolidação da jurisdição europeia de direitos humanos, questionando-se de que forma pode se dar a relação entre tal consolidação e a questão da segurança nacional. Ademais, intenciona-se argumentar que a situação normativa dos Estados Unidos no pós 11 de setembro demonstra que a escolha pela segurança nacional, em detrimento da proteção de direitos humanos, pode ter consequências muito severas, relacionadas à normalização do estado de exceção. |
| Abstract: | This article intends to analyse the legal and political issues regarding the terrorist attacks suffered by France in November 2015, specifically the questions surrounding counterterrorism measures. Using the European Court of Human Rights, it aims to demonstrate how the consolidation process of the European jurisdiction of human rights has being happening over the years, questioning the relationship between such consolidation and the national security issue. Furthermore, it intends to argue that the US normative situation after the 9/11 shows that the preference for national security at the expense of human rights protection can result on hard consequences related to the normalization of the state of exception. |
