Resumo: | O presente trabalho se propõe principalmente a superar a visão que perdurou ao longo da história da filosofia acerca dos sofistas, pensadores do século V a.C., como simplesmente desinteressados da justiça e da verdade, além de terem como adversários filósofos como Sócrates, Platão e Aristóteles. A dissertação inicia problematizando as fontes e os relatos acerca de tais pensadores, reconstruindo suas ideias tendo em vista todo o contexto conflitivo e de mudanças no qual se encontravam, transparecendo como verdadeiros representantes da nova ordem democrática. Dá-se especial atenção à sua influência para a democracia direta na Grécia Antiga e sua importância para o campo do direito, deixando claro que realmente preocuparam-se com temáticas jurídicas. Tais pensadores tinham concepções de justiça que, apesar de relativistas, não eram arbitrárias. Vários são os critérios mencionados por eles a respeito da justiça e comentados neste trabalho tais como o útil, o vantajoso, a verossimilhança, a concórdia, o senso de respeito, a necessidade, a prudência e a correção ou adequação. Além disso, são trabalhados vários outros temas jurídicos discutidos pelos sofistas, tais como a distinção entre phýsis e nómos, diversas críticas a sistemas de poder e discussões sobre educação e técnicas jurídicas. Ademais, busca-se analisar as imbricações de seu pensamento na cultura jurídica e na política grega e as consequentes influências para o direito. |
Abstract: | This study aims mainly to overcome the vision persisted throughout the history of philosophy about the sophists, thinkers from the V century BC, as mere uninterested in justice and truth, and opponents of philosophers like Socrates, Plato and Aristotle. The dissertation begins questioning the sources and reports about such thinkers, rebuilding their ideas in view of all the conflictive and changeable context they were within, revealing themselves as true representatives of the new democratic order. Special attention is given to their influence to direct democracy in ancient Greece and their importance to the field of law, making it clear that they really concerned with legal issues. Such thinkers had conceptions of justice that, in despite of relativists, were not arbitrary. There are several criteria mentioned by them about justice and commented in this work such as the useful, the advantageous, the verisimilitude, the accordance, the sense of respect, the need, the prudence and the correctness or appropriateness. Also, various other legal issues discussed by the sophists are analyzed, such as the distinction between phýsis and nómos, several criticisms of power systems and discussions on education and legal techniques. In addition, it seeks to analyze the overlapping of their thinking in the legal culture and Greek politics and the consequent influences to law. |
