Abstract: | O patrimônio cultural vem sendo considerado, majoritariamente, como elemento do meio ambiente. Assim, não somente por sua importância, oriunda dos valores que lhe são ínsitos, mas também em virtude do crescimento da preocupação com viés ambiental, mercê da globalização e do incremento dos riscos, há necessidade de que todos os atores envolvidos na preservação exerçam seus papéis. Se, por certo, a participação popular se mostra essencial nessa seara, resta impossível não reconhecer que o papel do Estado ainda é preponderante, principalmente quando se cotejam culturas e estágios de desenvolvimento tão distintos; e a proteção ambiental ainda é vista como um entrave ao crescimento econômico. A mitigação da necessária e obrigatória intervenção estatal, segundo as três funções do poder, pode ser extremamente danosa. A proposta do presente estudo é analisar como se operou, no arcabouço jurídico nacional e internacional, tal inserção no meio ambiente, bem como seus consectários. Além disso, apoia-se na lei de política nacional de meio ambiente e no princípio da intervenção estatal obrigatória, para delinear o estágio atual de proteção e a aplicação da base principiológica socioambiental, com reforço na atuação estatal. O trabalho foi desenvolvido com base em revisão bibliográfica e estudo de casos, não havendo pretensão, por óbvio, de esgotar o tema, mas refletir sobre a concretização da proteção do patrimônio cultural, em sua máxima amplitude, a beneficiar e respeitar as atuais e futuras gerações. |
Abstract: | Cultural heritage has been considered mostly as an element of the environment. Thus, not only for its importance, that became from its values, but also because of growing concern about environmental bias, thanks to globalization and the growing risk, there is need for all stakeholders engaged in preserving their roles. If popular participation is essential, it remains impossible not to recognize that the role of the state is still prevalent, even when comparing cultures and different stages of development and environmental protection is still seen as an obstacle to economic growth. The mitigation required and mandatory state intervention, according to the three functions of power can be extremely harmful. The purpose of this study is to analyze how it operated in the national and international legal framework, one insertion, as well as their consequences. Also, if the law supports national environmental policy and the principle of state intervention required to outline the current state of protection and enforcement of environmental principled basis. The work was developed based on literature review and case studies, with no pretension, obviously, of exhausting the topic of discussion but to reflect about the implementation of protection in its fullest extent, to benefit and meet the present and future generations. |
