dc.description.abstractThe present paper discusses the unilateral declarations of States capable of creating legal obligations. It extensively analyzes the components and the main characteristics of these declarations in light of the relevant State practice and the decisions of the International Court of Justice (ICJ) dealing with this issue. Moreover, it will describe various unilateral acts in order to illustrate their criteria of validity and their legal effects. The ICJ’s judgments will be mentioned in order to present the legal conclusions of this Court on the classification of certain unilateral declarations as acts capable of instituting legal obligations. As a result, it is expected to confirm that unilateral acts are instruments often used by States in the international normative sphere to establish legal duties. Accordingly, it will demonstrate that the binding nature of these acts is evidence that good faith has a very important role in the international legal relations.pt_BR
dc.description.resumoO presente artigo visa discutir as declarações unilaterais estatais capazes de criar obrigações internacionais aos Estados que as proferiram. Para este fim, realizar-se-á uma extensa análise dos elementos constitutivos e das principais características dessas declarações à luz da prática estatal e das decisões da Corte Internacional de Justiça (CIJ) lidando com a matéria. No decorrer do trabalho, serão descritos diversos atos unilaterais a fim de exemplificar os seus critérios de validade e seus efeitos obrigacionais. As decisões judiciais da CIJ serão mencionadas com o intuito de apresentar as conclusões legais dessa Corte sobre a qualificação de certas declarações unilaterais como capazes de instituir obrigações jurídicas. Como resultado, espera-se comprovar que os atos unilaterais são instrumentos frequentemente usados pelos Estados na esfera normativa internacional para estabelecer deveres legais. Nesse sentido, demonstrar-se-á que o caráter vinculante desses atos é evidência de que a boa-fé possui um papel muito relevante nas relações jurídicas internacionais.pt_BR
