| Abstract: | Esta tese tem como objetivo realizar uma análise das teorias do comportamento judicial, especialmente os modelos atitudinais e estratégicos por meio da atuação do Supremo Tribunal Federal Brasileiro (STF). Nesse sentido, contém uma revisão de literatura sobre o comportamento judicial e sobre o papel político do STF, além de uma série de testes corroborando a hipótese de que as decisões do STF são fundamentalmente estratégicas. Por fim, apresenta um estudo de caso sobre o julgamento da Ação Penal 470, “mensalão”, que concatena as ideias desenvolvidas nos capítulos anteriores para elaborar uma interpretação que explica os resultados do julgamento por meio do comportamento estratégico. |
| Abstract: | This dissertation consists of an analysis of the judicial behavior theories, especially the attitudinal and strategic models. I conduct that analysis through the judgments of the Brazilian Supremo Tribunal Federal (STF). To do that, it presents a literature review of the judicial behavior and the political role of the STF, in addition to a series of tests confirming the hypothesis that the STF decisions are mainly strategic. Finally, it presents a case study on the trial of Penal Action 470, also known as “mensalão”, witch concatenates the ideas developed in previous chapters to elaborate an interpretation that explains the results of the judgment through strategic behavior. |
