Abstract: En la presente tesis se analiza la legislación argentina en lo referido a salud mental y educación, sobre todo las cuatro leyes (conocidas como paquete de las 26) que producen una verdadera transformación jurídica en el país, ya que incorporan los postulados de la Convención Internacional por los Derechos del Niño (1989) y con ellas se ingresa a un paradigma de protección integral. También se revisa en profundidad el Acta de la Comisión Nacional Interministerial en Salud Mental y Adicciones (2014), en cuyas páginas se ofrece una serie de pautas y recomendaciones tendientes a evitar los diagnósticos apresurados y la medicalización de los niños a partir de la mera observación de conductas indeseables. Este documento y las mencionadas leyes se articulan con el pensamiento de Siegfried Bernfeld (1892-1953), pionero en el cruce entre Psicoanálisis y Educación. Se plantea un recorrido por la obra de este psicoanalista discípulo de Freud y se recupera su experiencia de educación antiautoritaria en la Colonia Infantil de Baumgarten, espacio en el que acogió a huérfanos de guerra en 1919. Luego, a partir del cruce entre las leyes y la obra de Bernfeld, se elaboran categorías intermedias que permiten abordar las tres dimensiones por las que, pese al gran avance en materia de derechos, aún se cuelan (sobreviven y se actualizan) las prácticas autoritarias del pasado: el lugar del adulto frente a los niños, la disciplina impartida desde una autoridad técnica y las condiciones institucionales que permiten o no abrir espacios de escucha. Finalmente, se retoman pasajes de la obra de Walter Benjamin (1892-1940), cuyas ideas acerca del teatro infantil proletario resultan afines al pensamiento de Bernfeld y a los postulados de la legislación argentina estudiada.
Abstract: This thesis analyzes Argentine legislation in relation to mental health and education, especially the four laws (known as the package of 26) that produce a true legal transformation in the country, since they incorporate the postulates of the Convention on the Rights of the Child (1989) and with them, a paradigm of integral protection is achieved. The Act of the National Interministerial Commission on Mental Health and Addictions (2014) is also reviewed in depth, in whose pages a series of guidelines and recommendations are offered to avoid hasty diagnoses and the medicalization of children from mere observation of undesirable behaviors. This document and the aforementioned laws are articulated with the thought of Siegfried Bernfeld (1892-1953), a pioneer in the intersection between Psychoanalysis and Education. A journey through the work of this psychoanalyst disciple of Freud is proposed and his experience of anti-authoritarian education is recovered in the Children's Colony of Baumgarten, a space where he welcomed war orphans in 1919. Then, from the intersection between the laws and in Bernfeld's work, intermediate categories are elaborated that allow addressing the three dimensions by which, despite the great advance in rights, authoritarian practices of the past still creep in (survive and are updated): the place of the adult compared to children, the discipline imparted by a technical authority and the institutional conditions that allow or not open spaces for listening. Finally, passages from the work of Walter Benjamin (1892-1940) are taken up, whose ideas about proletarian children's theater are related to Bernfeld thought and to the postulates of the Argentine legislation studied.
