Abstract: | Rawlsian accounts of tort law have argued for one of two extreme positions. Sometimes it is affirmed, as does Arthur Ripstein, that tort law must remain indifferent to the distributive goals that animate most part of Rawls’s conception of justice (e.g. the difference principle). For others, like Kevin Kordana and David Tabachnick, tort law is only defensible from a Rawlsianism perspective to the extent the former’s distributive effects are desirable. Distancing itself from both these extreme views, the paper explains why parties in Rawls’s original position cannot disregard issues of convergence between law and interpersonal morality. On one hand, convergence prevents tort law from being a mere tool to the pursuit of distributive goals. On the other hand, assuring convergence between tort law and interpersonal morality still allows for some distributivism in the realm of torts. |
Abstract: | Posicionamentos rawlsianos sobre a responsabilidade civil têm sustentado uma de duas teses extremas. Por vezes se afirma, como faz Arthur Ripstein, que a responsabilidade civil deve permanecer indiferente aos objetivos distributivos que animam a maior parte da concepção de justiça de Rawls (i.e., o princípio da diferença). Para outros, como Kevin Kordana e David Tabachnick, a responsabilidade civil apenas é defensável em uma perspectiva rawlsiana na medida em que seus efeitos distributivos forem desejáveis. Distanciando-se dessas duas visões extremas, este estudo explica por que as partes na posição originária de Rawls não podem desconsiderar questões de convergência entre o Direito e a moralidade interpessoal. Por um lado, a convergência evita que a responsabilidade civil seja um mero instrumento para a persecução de objetivos distributivos. Por outro, assegurar a convergência entre a responsabilidade civil e a moralidade interpessoal ainda permite algum distributivismo na seara do ilícito civil. |
