| Abstract: | Argumenta-se o problema da “colonização” do direito contratual pelo princípio da diferença, aludido por Scheffler, em um trabalho recente, no qual a subordinação do direito privado, aos princípios da justiça de Rawls, é defendida (SCHEFFLER, 2015), e consideravelmente atenuado pelas prescrições do primeiro princípio da justiça (o princípio das liberdades básicas) acerca do Estado de Direito. |
| Abstract: | It is argued that the problem of “colonization” of contract law by the difference principle, mentioned by Scheffler in a recent paper in which the subordination of the private law to Rawls’ principles of justice is defended (Scheffler, 2015), is considerably diminished by the prescriptions of the first principle of justice (The Greatest Equal Liberty Principle) concerning the Rule of Law. |
