| Abstract: | Neste artigo, o campo da filosofia do Direito, procuraremos abordar, a partir da metodologia da análise imanente – explicitada no Brasil por José Chasin, na esteira de Gyögy Lukács – a questão da justiça em Marx e Engels, tendo por objetivo primordial explicitar, a partir das determinações presentes no próprio texto dos autores aqui estudados, como as suas críticas ao Direito estão companhada de uma crítica decidida à noção de Justiça. Assim, buscaremos deixar claros nossos resultados: os autores, em verdade, não acreditam ser possível contrapor Direito e Justiça já que, efetivamente, a noção de Justiça traria, segundo os autores, certa ocultação das vicissitudes da Sociedade civil-burguesa, a sociedade capitalista mesma. Deste modo, nos autores do Manifesto Comunista, intentamos concluir que a questão da justiça é inseparável do terreno do Direito e ela pressupõe determinado modo de produção, o capitalista, tendo-se, nestes autores alemães do século XIX, a crítica a qualquer concepção de “Justiça eterna” ou de “Justiça das transações”. |
| Abstract: | In this article, in the field of Philosophy of Law, taking in account the method of immanent analysis, elaborated in Brazil by José Chasin, fallowing György Lukács, we intend to analyze Marx and Engels´ treatment of the matter of Justice. The objective of this article is to analyze the texts of the authors mentioned and to prove that: Justice, as well as Law itself, is criticized by the German authors and, because of that, it is impossible, in their work, to see Justice as something that can be opposed to Law. As a result, the authors think that the matter of Justice would, in fact, hide the central flaws of capitalism itself: the authors of the Communist Manifesto, actually, say in their work that the idea of Justice, in the XIX century, presupposes a given mode of production. As a conclusion, it would be impossible to search to any kind – even a critical one – of “eternal Justice” or “Justice in transactions”. |
