| Abstract: | Pretende-se problematizar a possibilidade de uma teorização positiva da questão da justiça a partir da obra de Karl Marx. Procurar-se-á demonstrar que o texto marxiano relaciona a noção de justiça às esferas da distribuição e da circulação de mercadorias, apontando que a noção de justiça se apresenta somente ao deixar intocada a esfera produtiva. A partir disto, tentar-se-á trazer à tona o modo como, em Marx, há uma relação entre a noção e o modo de produção capitalista, a qual é explicitada ao se tratar da conformação objetiva do trabalho abstrato e da forma de equalização baseada nela e existente na sociedade capitalista. Por fim, restará clara a crítica de Marx à noção de justiça, trazendo-se à tona a inseparabilidade entre a esfera jurídica e a primeira. |
| Abstract: | We intend to analyze Marx´s relation with the matter of Justice. First, it is key to show how that sphere is intimately related to the distribution and the circulation of commodities. According to Marx, it occurs as long as production itself is not actually analyzed. It is presupposed. After that, we will make explicit the relation between abstract work and the form of equality present in the capitalist society. In the end, it will be clear that Marx is a critic of Justice and sees it as inseparable from the juridical sphere. |
