| Abstract: | No presente artigo, a partir de textos centrais do itinerário intelectual de Marx, pretendemos tratar da relação entre crítica da economia política e crítica do Direito no autor. Para tanto, analisaremos a posição do autor de O capital sobre a economia política em um primeiro momento, comparando aquilo que diz em 1844, nos Manuscritos econômico-filosóficos com o que diz em sua ‘maturidade”. Depois, procuraremos ver até que ponto a tentativa pachukaniana de aproximar as duas críticas, a do Direito e a da economia política, é algo já presente explicitamente no texto marxiano. Para tanto, procuraremos destacar as aproximações e os distanciamentos do autor de Teoria geral do Direito e o marxismo frente àquilo colocado por Marx em suas obras. Por fim, procuraremos mostrar a diferença específica existente, segundo Marx, entre a teoria do Direito e a economia política. Com isso, acreditamos, restarão claras as razões pelas quais tem-se o ponto de partida marxiano em uma crítica à economia política. |
| Abstract: | On the present article, we intend –taking in account Marx´s texts -to relate his critic of Political Economy with the critic of Law. To begin with, we will analyze the Marxian position on The capital,comparing that position with that of the Economical and philosophical manuscriptsof 1844. Than, having in mind the precedent discussion, we intend to desagree with the pachukanian position on the relation between critic of politicaleconomy and the critic of Law. Having in mind the differences and the proximity of Marx and Pachukanis, we will present the difference between theory of Law and political economy in Marx, therefore, showing some reasons why Marx takes as an essential taskof his theory the critic of political economy. |
