Marx: crítica do direito e crítica à economia política

Abstract

We will analyze the Marxian itinerary with respect to the relation between critique of Law and critique of political economy. We will take as parameter three moments the author’s work. The first, of rupture, in which he develops a critique of Law that turns directly against Hegel and against great exponents of the political economy; the second moment appears in the Marxian critique of Proudhon, in which the latter, in a certain way, having Law as a pivotal point, can be seen as an epigone of Hegel, although not only. Finally, we will bring late Marx’s position on two essential authors for the conformation of the “theory of law”, Austin and Bentham. These, leaving aside any debate with Hegel, and accepting uncritically the vulgar economy, are seen by Marx as a clear expression of the apology to the existing.
