dc.description.abstractThe model of the democratic state of law adopted by post-war Western democracies implies a paradigmatic, theoretical and pragmatic transformation of the jurisdiction and role of the judiciary. In this perspective, it is incumbent upon the Judiciary to contribute, effectively, to the realization of the constitutional project of the democratic society. That requirement implies a change to a new epistemology to the understanding of social, economic, political and juridical phenomena, which must be capable of overcoming the traditional juridical rationality of the liberal-technicist-positivist jurisdictional practice associated with the model of the liberal state. In Latin America there is a gradual self-understanding of the constitutional courts and the judiciary of the constitutional mission conferred on it by the Constitutional Democratic State of Law.pt_BR
dc.description.resumoEl modelo de Estado adoptado por las democracias occidentales en la post-guerra implica una transformación paradigmático, teórico y pragmático, de la práctica jurisdiccional y de la función del Poder Judicial. En esta perspectiva, el Poder Judicial es llamado a contribuir, eficazmente, a la realización del proyecto constitucional de la sociedad democrática. Tal exigencia requiere una nueva epistemología indispensable para la comprensión de los fenómenos sociales, económicos, políticos y jurídicos en su complejidad, con la superación de la racionalidad jurídica tradicional de carácter liberal-técnico-positivista derivada y que subyacente a la práctica jurisdiccional del Estado liberal. Hay, en América Latina, una progresiva auto-comprensión de los tribunales constitucionales acerca de la misión constitucional del Poder Judicial en el Estado Constitucional Democrático de Derecho.pt_BR
