Abstract: | A entrada em vigor do CPC de 2015 suscita problemas, alguns dos quais, todavia, já resolvidos pela doutrina que propiciou a própria evolução legislativa. É o que se passa com o objeto do processo e os limites objetivos da coisa julgada, quando o legislador adotou o precioso ensinamento de um dos maiores processualistas de todos os tempos, elaborado durante a vigência do CPC revogado, porém ao corrente da solução das dúvidas ensejadas no direito pátrio e no europeu. |
Abstract: | The came into force of the 2015 Civil Procedure Code arouses some issues, some of them already settled by scholars who have allowed the legislative evolution. That’s what came to happen with the object of the procedure and the objective limits of res judicata, by the time the law adopted the theory of one of the major civil proceduralist of all time, conceived during the term of the revoked Brazilian Civil Procedure Code and according to solutions to Brazilian and European issues. |
