| Abstract: | Neste artigo buscamos analisar alguns debates, historicamente travados no cenário dos Estados Unidos, no que se refere ao sentido da liberdade acadêmica, enfatizando a necessidade de se distinguir liberdade de expressão e liberdade acadêmica. Para isto, selecionamos algumas decisões da Suprema Corte que abordam, direta ou indiretamente, esta questão. Estes casos foram o ponto de partida para demonstrarmos que a Suprema Corte não realiza esta distinção, permanecendo em uma zona de confusão e ambiguidade, aplicando sua visão da liberdade de expressão à liberdade acadêmica, desconhecendo todas as singularidades normativas que esta revela possuir. |
| Abstract: | This paper intends to discuss the debates, historically occurred in the United States scenario regarding the meaning of academic freedom, emphasizing the need to distinguish freedom of expression and academic freedom. For this, we selected some decisions of the Supreme Court that address, directly or indirectly, this question. These cases indicate that the Supreme Court does not make this distinction, remaining in a zone of confusion and ambiguity, applying its vision of freedom of expression to academic freedom and ignoring all the normative singularities that it reveals to possess. |
