dc.description.abstract | This article’s central objective is to elucidate the debate over the constitutionality of legal statutes that allow state-members to make use of judicial and extrajudicial deposits, in order to pay for various expenses. This will be done so in light of the current fiscal and financial crisis, and by taking into account the need to find new forms of financing public benefits, beyond simply increasing the levels of taxation or, worse, borrowing from the same banks that keep the deposits. We will begin by clarifying what is at stake behind this whole controversy: what is the real purpose of the laws in question, to whom they are directed, which guarantees are offered to the depositors, and particularly who is really affected by this legislative innovation. By bringing to light the political and economic origins of the dispute, which resulted from a series of constitutional actions brought before the Brazilian Supreme Court, we intend to correct a few errors in the treatment of this matter. Here, the paper will consider the role and the limits of judicial review, especially the problematic of the legalization or judicialization of political issues. Finally, we shall set out what we believe to be the true legal problem at hand, namely, the compatibility between federal and state rules regarding the public allocation of the deposits. | pt_BR |
dc.description.resumo | O presente artigo tem por finalidade central elucidar os debates acerca da constitucionalidade do uso, por parte dos entes federados, de depósitos judiciais e extrajudiciais, para o pagamento de despesas diversas, à luz do atual cenário de crise financeira e fiscal e da necessidade de se encontrar novas formas de financiamento público, para além do simples aumento dos níveis de tributação ou, pior, da obtenção de empréstimos junto às próprias instituições bancárias que custodiam os depósitos. Como primeiro objetivo, portanto, buscaremos esclarecer o que está em jogo por detrás de toda a polêmica: qual o verdadeiro desígnio das leis em questão, para quem se voltam, quais as garantias oferecidas aos depositantes, e sobretudo quem é realmente afetado por essa inovação legislativa. Em seguida, procederemos à correção de alguns equívocos no tratamento da matéria, o que será feito trazendo-se a lume as origens políticas e econômicas da controvérsia, instaurada a partir do ajuizamento de uma série de ações diretas de inconstitucionalidade perante o Supremo Tribunal Federal. Um outro propósito do texto é abordar a forma como o tema tem sido enquadrado judicialmente, tendo em vista o papel e os limites da jurisdição constitucional no controle e na preservação da integridade do direito, em face dos problemas ligados à chamada “judicialização da política”. Por último, exporemos o que acreditamos ser a verdadeira quaestio juris a merecer atenção da doutrina, a saber, a conformidade entre os regramentos federal e estaduais, no que tange à destinação pública dos valores depositados. | pt_BR |
