| Abstract: | Pretende-se neste trabalho, via Análise Econômica do Direito, identificar, de forma construtiva, que a atual redação da Lei 11.101/05 enseja assimetria de informações, o que contribui para a sua ineficiência. A metodologia a ser utilizada é de método dedutivo, mediante abordagem explicativa e descritiva, além de pesquisa bibliográfica. Inicialmente será feita uma contextualização do tema, mediante abordagem dos princípios da função social e preservação da empresa. Após, serão identificados os aspectos existentes na Lei de Recuperação de Empresas e Falência que permitem afirmar que há, sim, forte ensejo à assimetria de informações. |
| Abstract: | This work, through Economic Analysis of Law, aims to constructively identify the current wording of Law 11.101 / 05 asymmetry of information, which contributes to its inefficiency. The methodology to be used is a deductive method, through an explanatory and descriptive approach, as well as bibliographic research. Initially a contextualization of the theme will be made, by approaching the principles of social function and preservation of the company. Afterwards, the aspects in the Law on Corporate Recovery and Bankruptcy will be identified, which allow us to affirm that there is a strong opportunity to asymmetry of information. |
