| Title: | Direitos humanos e a Corte Internacional de Justiça: um estudo de caso sobre a aplicação da Convenção de Genocídio pela CIJ |

| Abstract: | Este artigo visa a discutir as especificidades de um julgamento internacional envolvendo graves violações de Direitos Humanos e a maneira como o judiciário internacional aborda a questão, notadamente, a Corte Internacional de Justiça. Discute-se a importância do judiciário no reconhecimento das vítimas e a sua influência na formação da memória do conflito, podendo (ou não) contribuir para a sua superação e recomposição do tecido social. Realiza-se uma breve revisão sobre como o assunto é tratado nas Cortes especializadas em Direitos Humanos e pelos Tribunais Penais Internacionais para, finalmente, analisar como a Corte Internacional de justiça trabalha a questão. Ao final tem-se um estudo de caso envolvendo o julgamento pela Corte Internacional de Justiça da demanda Bósnia VS. Iugoslávia (Sérvia) e Croácia VS. Sérvia discutindo o descumprimento da Convenção de Genocídio no contexto da dissolução da Ex-Iugoslávia. |
| Abstract: | This paper addresses the specificities of international trials of gross human rights violations and how international courts approach this issue, notably, the International Court of Justice. We discuss the importance of international trials in recognizing victims and how they can influence the construction of their memories and overcoming trauma and rebuilding social tissue. We revise how International Courts specialized in Human Rights and International Criminal Tribunals have been dealing with the matter so that we can, finally, address the International Court of Justice. In conclusion, there is a case study of the trials before the ICJ regarding violations to the genocide convention in the dissolution of the former Yugoslavia, case Bosnia vs. Former Yugoslavia (Serbia) and Croatia VS. Serbia. |
