| Abstract: | A Constituição da República de 1988 garante o direito ao meio ambiente ecologicamente equilibrado, além de impor o dever a todos os cidadãos de proteção desse meio ambiente, segundo o princípio de participação. O mecanismo judicial da ação popular tem sido compreendido como o mais democrático, podendo ser utilizado por qualquer pessoa. Além disso, o acesso à justiça pode ser compreendido em sentido amplo, a partir da concretização do acesso à informação e a participação social. Buscou-se neste artigo analisar ainda como a aplicação da Lei n. 10.650/03 vem sendo realizada por alguns dos tribunais nacionais, no intuito de verificar se há uma demanda relativa ao acesso à informação como parte intrínseca do direito à participação e do acesso à justiça. |
| Abstract: | The Constitution of 1988 guaranties the right to a healthy and balanced environment; besides, it imposes the common duty to all citizens to protect this environment, according to the participation principle. The judicial mechanism of popular action is being related as the most democratic, as it can be used by anyone. Nowadays, there are social movements that demand also assurance for efficient and better access to the environmental tutelage. This article also aims to analyze the application of the Law n. 10.650/03 by some national courts, in order to verify if there is a demand related to the access to information as intrinsic part of the participation right and the access to justice. |
