| Abstract: | El crecimiento de los casos relativos a la práctica del bullying (acoso) en el ambiente escolar han generado numerosas discusiones sobre la responsabilidad civil. Así, se buscará analizar como las prácticas de acoso en la escuela pueden combatirse desde una perspectiva de la protección derivada de los derechos fundamentales, anclada aún en las decisiones judiciales existentes sobre el tema. Como resultado, se puede afirmar que, aunque las instituciones de enseñanza posean el deber temporal de guardia y vigilancia sobre el niño o adolescente, tal hecho no podrá considerarse como suficiente para elidir la responsabilidad constitucionalmente atribuida a los padres de educar sus hijos. |
| Abstract: | The growth of cases relating to the practice of bullying in the school environment have generated numerous discussions on liability. So, we will seek to analyze the practices of bullying at school can be fought from the perspective of the protection stemming from fundamental rights, yet anchored in existing court decisions on the subject. As a result, we can say that although educational institutions possess temporary duty to guard and watch over the child or adolescent, this fact can not be considered sufficient to elide constitutionally attributed to the responsibility of parents to educate their children. |
