| Abstract: | Busca-se analisar as premissas e efeitos do dever de fundamentação na prolação de decisões judiciais, sobretudo em matérias de cunho técnico-científico, estabelecendo-se os critérios necessários para que os Tribunais promovam a adequada fundamentação das decisões, visando garantir a estabilidade, integridade e coerência da jurisprudência (art. 926 do CPC). Em especial, será analisado se o acórdão prolatado pelo STF nos autos do ARE 664.335 observou o princípio do dever de fundamentação ou se o precedente carece de superação. |
| Abstract: | It seeks to analyze the premises and effects of the duty to state reasons in the rendering of judicial decisions, especially in matters of a technical-scientific nature, establishing the necessary criteria for the Courts to promote the adequate grounds for decisions, in order to guarantee the stability, integrity and coherence of case law (Article 926, CPC). In particular, it will be examined if the judgment rendered by the STF in the case of ARE 664.335 observed the principle of the obligation to state reasons or if the precedent needs to be overcome. |
