Abstract: | Com a evolução tecnológica, profundas alterações foram trazidas na relações de trabalho, principalmente com o surgimento da informática e da automação. Com isso, surgiu o teletrabalho, que é uma modalidade de trabalho prestado a distância do empregador, mediante o uso de instrumentos de telecomunicação. Hoje, o teletrabalho é uma realidade em vários países, mas não há ampla regulamentação acerca do assunto nos diversos ordenamentos jurídicos. A Organização Internacional do Trabalho não dispõe de normas específicas acerca do teletrabalho, mas entende-se que são aplicáveis, no que couberem, as normas atinentes ao trabalho em domicílio, para os teletrabalhadores que trabalham em seu domicílio. O Brasil ainda não possui normas regulamentadoras, apenas reconhece a relação de trabalho subordinado ao teletrabalhador que comprovar a relação de dependência e controle. A Itália, por sua vez, já possui uma maior regulamentação, mas por meio de acordos coletivos. Quanto à legislação, apenas regulamenta o teletrabalho na Administração Pública. Brasil e Itália se assemelham no fato de terem a noção de subordinação jurídica e trabalho autônomo semelhante e de entenderem o mesmo conceito doutrinário de teletrabalho. Se diferem em razão de a Itália ter criado o instituto da parassubordinação e pelo fato de estar um pouco mais a frente do Brasil em termos de regulamentação, pois já prevê o teletrabalho no âmbito da administração pública e possuir acordos coletivos acerca do tema. |
Abstract: | Technological developments brought major changes in labor relations, especially with the advent of computers and automation. Telework is a type of work performed away from the employer, through the use of telecommunication tools. Today, telecommuting is a reality in several countries, but there is no regulation about the subject in the various jurisdictions. The International Labor Organization has no rules about telecommuting, but it is understood that apply in that fit the rules pertaining to the work at home, for teleworks working at home. Brazil does not have any regulatory standards, only recognizes the employment relationship subject to the teleworker to prove the relationship of dependency and control. Italy, in turn, already has more regulation, but through collective agreements. The legislation only regulates telework in Public Administration. Brazil and Italy are similar in the fact that the concept of legal subordination and self-employment identical and understand the same doctrinal concept of telework. Differ because of Italy be a little ahead of Brazil in terms of regulation, as already provided for teleworking in the public administration and have collective bargaining agreements on the subject. |
