Abstract: | O presente trabalho tem como propósito informar sobre a demanda do Serviço Social e sua competência para atuar no processo de reabilitação profissional. Entretanto, apesar da sua competência, o sistema de reabilitação profissional, muitas vezes, tem sido tirado do trabalhador com um direito. O Estado através da Autarquia Previdenciária, representado pelo INSS, tem negado o direito de muitos trabalhadores acometidos por doença ocupacional que saem em busca da judicialização para ter seus direitos preservados. Falta a aplicação prática no sistema de previdência brasileiro. Os trabalhadores são inseridos em um processo de reabilitação profissional sem critérios de legislação da saúde do trabalhador e, muitas vezes, sem o devido cumprimento judicial conquistado pelo trabalhador por vias jurídicas. O objeto da pesquisa está fundamentado em demonstrar a importância do Serviço Social e as dificuldades enfrentadas pelo trabalhador que se encontra desamparado. Os objetivos são informar, esboçar, citar e justificar o tema aqui proposto através de um estudo de caso. Muitas vezes, o trabalhador se sente desgastado pelas repetidas situações de dificuldades imposta pelo próprio sistema. Sendo assim, esta pesquisa se desenvolve em forma de revisão bibliográfica, com análise crítica através do estudo de caso, de forma a sustentar os argumentos e contribuir de forma que outros trabalhadores possam cuidar de sua saúde profissional sem riscos impostos pelo sistema. |
Abstract: | This article aims to inform about the demand for social service and its competence to act in the professional rehabilitation process. However, despite its competence, the occupational rehabilitation system was often deprived of the worker's right. The State, through the Social Security Autarchy, represented by the INSS, denied the right of many workers affected by occupational diseases who seek judicialization to preserve their rights. There is a lack of practical application in the Brazilian social security system. The workers are inserted in a professional rehabilitation process without criteria of the worker's health legislation and often without the due judicial compliance reached by the worker by legal means. The objective of the research is to demonstrate the importance of Social Work and the difficulties faced by workers who are totally helpless, being removed from their rights. The objectives are to inform, outline, quote and justify the theme proposed here through a case study. Often, the worker feels tired by the repeated situations of difficulties imposed by the system itself. Therefore, in the work presented here in the form of a bibliographic review, the criticisms come through the case study, supporting the work that opes, through the report, here in the form of an outline, that other workers can take care of their health without risks imposed by the system. |
