As ações afirmativas na nova lei de licitações

Abstract

It was intended to carry out, within the scope of this research, an analysis of the affirmative actions brought by Federal Law No. moment of contract execution, based on the constitutional principle of equality. For the research to this end, the theoretical framework of the present research is based on the current legislation on the subject, especially on the new General Law of Bidding. In this, the methodology had an analysis of the doctrine, scientific articles, jurisprudence indexed on the websites of Brazilian courts, and the legislation on the subject. In view of this, the problem formulated translates into the following question: how to promote affirmative action in the context of public bidding? Considering the importance of the actions alleged and or maintained by the new legislation, for the development of a democratic society of action to actions if founded on the legislation, as well as the actions that exist, as well as enabling them to be protected. However, there is no need to discuss the greater public offer to the private partner when implementing the mentioned policies, for the implementation of public policies in the context of a public contract, which requires resources of all kinds. Despite the challenges encountered, as affirmatives, they were presented as an important vector in the fight against social inequality and segregation, driven by democracy for the effectiveness of Brazilian regulations.
