| Abstract: | A Liberdade de Expressão, que pode ser manifestada de diversas formas, consiste em um Direito Fundamental, que visa a combater o autoritarismo estatal e tem a sua previsão nos artigos 5o, incisos IV,IX, XIV e 220, §§ 1° e 2o da Constituição Federal de 1988. Além de debater sobre a liberdade de expressão, o presente artigo teve por objetivo central examinar a disseminação de notícias falsas, mais conhecidamente como Fake News, verificando, brevemente, seu aspecto histórico, suas definiçõese suas possíveis consequências. O presente trabalho discute, ainda, se a liberdade de expressão pode ser manifestada de forma absoluta, bem como se ela é amparada pela disseminação de notícias falsas contra pessoas ou instituições. Em conclusão, apresentamos três possíveis formas de combate às Fake News: alfabetização digital como política pública, contradiscurso e uma análise jurídica/regulatória. |
| Abstract: | Freedom of Speech, which can be manifested in different ways, consists of a Fundamental Right, which aims to tackle state authoritarianism and is ruled by Articles 5, items IV, IX, XIV and 220, §§ 1 and 2 of the Federal Constitution of 1988. In addition to debating freedom of speech, the main objective of this article is to examine the dissemination of false news, known as Fake News, verifying its historical aspects, definitions and possible consequences. The present work also discusses whether freedom of speech can be manifested absolutely, as well as whether it is supported by the dissemination of false news against people or institutions. In conclusion, we present three possible ways to tackle News: digital literacy as public policy, counter-discourse and a legal/regulatory analysis. |
