Comitê gestor para tratamento das ações de inventário e usucapião: uma proposta de design de sistema baseada em uma experiência vivenciada na comarca de Santa Luzia/MG

Abstract

Inventory and adverse possession are actions, the procedures for which are very specific and provided with numerous details. The processes involving these actions are often difficult to manage, given the large amount of information that can be contained in each of them. This situation tends to get much worse in districts in the interior of the country where there are no specialized judicial bodies, which can result in disorganization of the procedure, excessive delays and rework. Aiming to correct this problem, based on the theory of conflict resolution system design, a proposal was formulated to create and install a Management Committee, body or program, within the organization chart of the Court of Justice of Minas Gerais and which would serve the districts from the interior of that state. This system design was designed to be a channel for cooperation between the Court of Justice and services without specialized judicial bodies and with the aim of helping to reduce the collection relating to the aforementioned actions. The workflow would involve the issuance of certificates of regularity, a procedural mechanism that would mirror the procedure, both in terms of its possible pending issues and in relation to the procedural phase it is currently in. To prove the hypothesis, 02 (two) methods were used to diagnose the problem and support a solution, namely, the analysis of the certificates that were issued between the years 2017 and 2022 in Santa Luzia/MG, as well as those that were part of the pilot project installed in the same district in the first half of 2023. The results obtained allow us to infer that the Management Committee, the certificate of regularity and its effective contribution to the process would be important tools for the management of inventory and adverse possession actions , in the context of the districts in the interior of the State of Minas Gerais that do not have judicial bodies specialized in these matters, as they could facilitate their processing and judgment.
