| Abstract: | El Gobierno Federal Alemán propuso, en 2020, el Proyecto de Ley para el Fortalecimiento de la Integridad en la Economía, que prevé sanciones a las organizaciones. La propuesta trae un turbo modelo de responsabilidad, cuyos referenciales argumentativos y naturaleza jurídica vienen siendo cuestionados. El presente trabajo analiza el Proyecto de Ley y concluye que el mismo pretende instituir responsabilidad penal para las organizaciones, adoptando inconsistente modelo, basado tanto en el defecto de organización como en el hecho de conexión. |
| Abstract: | The German Federal Government proposed, in 2020, the Bill for the Strengthening of Integrity in the Economy, that provides for sanctions to organizations. The proposal has a blurred model of liability, whose argumentative references and legal nature have been questioned. This article analyzes the Bill and concludes that the Bill intends to institute criminal liability for organizations, adopting an inconsistent model of liability based on the argumentative references of the organizational fault and the act of connection. |
