Abstract: | O presente texto tem como objetivo apresentar legislação que serviu de referência para a organização de ações referentes à Educação Especial na atual perspectiva da Inclusão no Brasil; discutir algumas características que permitem elucidar os embates ideológicos constitutivos da sociedade, e que, portanto, favorecem interpretações polissêmicas de tais documentos; abordar a Política Nacional de Educação Especial por meio dos Planos Nacionais de Educação inscritos como Leis tencionando a discussão de que a Lei por si só não modifica as bases que sustentam a Educação Especial. Para tanto buscou‐se apoio teórico em autores que abordam a correlação entre os embates de diferentes forças sociais relacionando às influências tanto na legislação quanto na prática e ação voltadas para o alcance da qualidade almejada na educação e mais especificamente na Educação Especial, além de autores que empreendem a crítica do e no campo, como possibilidade de avanço nas discussões. Estabeleceu‐se como metodologia: a) análise do material legal, a saber, Resolução CNE/CEB nº 2/ 2001, a Política Nacional de Educação Especial na Perspetiva da Educação Inclusiva de 2008, a Resolução nº4/2009, e os Planos Nacionais de Educação (2001 e 2014); b) comparação entre a documentação; c) estabelecimento de diferenças, semelhanças e rupturas na forma de conceituar o sujeito alvo da Educação Especial. |
Abstract: | The present text has as its objective to present the legislation that was used as a references to the organization of actions that relate to the Special Education on the current perspective of Inclusion in Brazil; to discuss some characteristics that allowed us to elucidate the ideological conflicts the society, that, therefore, favors various interpretations of such documents; addressing the national Special Education Policy through national plans of Education enrolled as laws intending to the discussion that the law by itself does not modify the foundations that underpin special education. For both sought theoretical support in authors who address the correlation between the conflicts of different social forces relating to both influences in legislation and in practice and action geared to the achievement of the desired quality in education and more specifically on special education, as well as authors who undertake the review of and in the field, as the possibility of progress in the discussions. Was established as methodology: a) the analysis of the legal material, namely, resolution CNE/CEB No. 2/2001, the National Policy on Special Education from the Perspective of Inclusive Education in 2008, resolution No. 4/2009, and the National Education Plan (2001 and 2014); b) comparison between the documentation; c) establishing differences similarities and breaks in the form of conceptualizing the subject target of special education. |
