| Abstract: | Este artigo versa sobre a incorreção na utilização de termos técnicos jurídicos, no âmbito da imprensa brasileira, com base no jornal popular digital O Tempo. A metodologia utilizada neste trabalho foi a jurídico-sociológica; já os métodos, foram o analítico-descritivo e o qualitativo. Com apoio nos aportes teóricos de Silva (2008), Sabbag (2016) e Nogueira e Agnez (2016), dentre outros, objetivando identificar e analisar incorreções na adaptação da linguagem jurídica no âmbito do jornalismo popular brasileiro, buscou-se respostas ao seguinte tema-problema: como os termos técnicos jurídicos empregados em notícias veiculadas pelo jornal O Tempo podem ser adaptados para uma linguagem simples? A hipótese para esse problema de pesquisa, confirmada ao final deste trabalho, foi que determinados termos podem ser adaptados para uma linguagem simples mediante a substituição por sinônimos mais simples, enquanto outros termos não admitem adaptação, de modo que devem ser explicados e contextualizados para os leitores leigos em Direito. Atingido o objetivo desta pesquisa, constatou-se que a prática de sensacionalismo, a simplificação inadequada da linguagem jurídica e a aparente insuficiência na formação acadêmica de profissionais da área de Comunicação Social são alguns dos fatores responsáveis pela recorrência das inadequações na utilização de termos técnicos jurídicos por jornalistas. Ademais, verificou-se que a maior parte dos autores das notícias analisadas não possui compromisso com a transmissão fidedigna de informações jurídicas. Verificou-se, ainda, que a compreensão da linguagem jurídica pela população é um pressuposto inafastável para a garantia do acesso à Justiça e para a defesa da democracia, o que evidenciou a importância acadêmica deste estudo para o campo do Direito, e que também cabe à população buscar desenvolver a sua capacidade de compreensão jurídica. Por fim, concluiu-se que a inserção de ao menos duas disciplinas de Direito no curso de Jornalismo tem o potencial de cercear os efeitos negativos do emprego inadequado de termos técnicos jurídicos identificados neste estudo. |
| Abstract: | This article deals with the incorrect use of technical legal terms, within the scope of the Brazilian press, based on the popular digital newspaper O Tempo. The methodology used in this work was legal-sociological; the methods, in turn, were analytical-descriptive and qualitative. With support from the theoretical sports of Silva (2008), Sabbag (2016) and Nogueira and Agnez (2016), among others, aiming to identify and analyze inaccuracies in the adaptation of legal language within the scope of Brazilian popular journalism, we sought answers to the following research problem: how can the technical legal terms used in news published by the newspaper O Tempo be adapted into simple language? The hypothesis for this research problem, confirmed at the end of this work, was that certain terms can be adapted to a simple language by replacing them with simpler synonyms, while other terms do not admit adaptation, so they must be explained and contextualized for the lay readers in Law. Having achieved the objective of this research, it was found that the practice of sensationalism, the inadequate simplification of legal language and the apparent insufficiency in the academic training of professionals in the area of Social Communication are some of the factors responsible for the recurrence of inadequacies in the use of technical legal terms by journalists. Besides, it was found that most of the authors of the news analyzed are not committed to the reliable transmission of legal information. It was also found that the population's understanding of legal language is an indispensable prerequisite for guaranteeing access to Justice and for the defense of democracy, which highlighted the academic importance of this study for the field of Law, and that it is also up to the population to seek to develop their capacity for legal understanding. Finally, it was concluded that including at least two Law subjects in the Journalism course could limit the negative effects of the inappropriate use of technical legal terms identified in this study. |
