O gesto por vir do Direito e Literatura: a escrevivência de Conceição Evaristo como um projeto estético-político-jurídico

Abstract

Is it possible to think about law through escrevivência? There is another way of thinking about and reading literature in writing, which starts from the ethnic and gender component. Escrevivência is a collage of the terms "writing", "seeing" and "living". This aesthetic-political project, whose content is testimonial, has been developed by Conceição Evaristo since her master's thesis at the Pontifical Catholic University of Rio de Janeiro. With the author, we see that the black woman-body inverts and displaces the universal logos in which it was historically placed. This body does not exist as an origin, which would refer to presence, but rather as a game of historically constructed meanings, which can therefore be deconstructed. In our reading, Evaristian strategy deconstructs the place in which black women are placed in literary discourse. The power of this escrevivência is beyond and beyond the collage of these terms, and in the life and fiction that merge and confuse: there is the performance of new stories, so that there is a re-reading and re-signification of official history. In these movements, we have the idea of historical justice, in the face of historical responsibility for the violation of human rights. In this sense, historical justice is intrinsically linked to memory, as a political and legal measure to confront violations resulting from race, such as colonization and enslavement, for example. Expanding on Conceição's aesthetic-political project, this research aims to bring escrevivência to the legal field, proposing it as an aesthetic-political-legal project, insofar as it provides new access to the history of rights in Brazil. Our initial hypotheses are as follows: (i) escrevivência makes the ethical commitment of deconstruction justice in its aesthetic form, given the displacements present in this writing, so that by inscribing the testimonial scene of escrevivência in the Law, there is the performance of justice for those silenced and erased by history and legal coloniality; (ii) the aesthetic-political project of escrevivência is a gesture, which is related to narrating the unspeakable and to the politics of memory, from which, in the act of legence, we can observe ethical-aesthetic-legal particularities. For this reason, in addition to being an aesthetic-political project, escrevivência is also a legal project. (iii) the aesthetic-political-legal project of escrevivência comprises a new path for the relationship between Law, Literature, History, and Philosophy. As a theoretical-methodological proposal, we highlight the legacies in deconstruction, with which we seek a history to come, that is, the opening up of other paths, other readings, and escrevivências on the history of law. This opening up of paths in Law and Literature studies is the reinvention of the very gesture of Law, its sources, and its history. Following in the footsteps of Luciana Pimenta, within the Legentes Research Group, we will work on the production of a Literary Law, a Law that has its main theoretical operator in the reading experience and seeks in Literature the source and support for the re-signification and re-writing of the History of Law, which also includes the meanings constructed by each reading/legence practice.
