Uma análise hermenêutica do art. 142 CRFB/88: a interpretação da análise do discurso dos atores públicos e a semiótica do poder.

Abstract

The crisis among the three branches of government, initiated by the Executive, will be discussed in our study. Article 142 of the Federal Constitution of 1988, often cited to justify military intervention, will be fundamental for examining the text of the constitutional provision. The concept of a moderating power will be evaluated within the political structure of Brazil between 2020 and 2022. This debate will be analyzed to understand the attacks on institutions during these years, culminating in the events of January 8, 2023. The President's government, which already had a military inclination, began to align more closely with the Armed Forces, appointing a significant number of military personnel to political leadership positions and strategic roles in ministries, thus ensuring alignment with the Executive Branch. Given this scenario, the ongoing crisis paved the way for the President to consider military intervention as a necessary measure. However, to implement this decision, actions that contradicted the Brazilian Judiciary were required. Based on the debates between the Executive and the Judiciary, the interpretation and importance of language will be investigated, with insights from the most relevant theorists in the study of language. The interpretation of the actors in relation to their audience becomes essential to make sense of the crisis and the actions that occurred among the branches of the Republic. It will be pertinent to examine the President's speeches, which garnered support from politicians and influencers on online platforms. Furthermore, we will analyze the speeches of Minister Alexandre de Moraes and the Supreme Federal Court (STF), which provided an important counterpoint in defending national institutions. Given this context, it will be necessary to evaluate language in its entire spectrum, both verbal and gestural, as these signals go beyond the words spoken. As we will see in our study, it is in this symbolic space that the identity of the actors and their followers resides. Thus, this will be a crucial source for understanding the thoughts and ideas of the political and legal leaders analyzed in this article. Finally, drawing from language theorists, we will interpret the concept of collective memory and its discourses, seeking to explain the influence of the actors on their audience.
