| Abstract: | A criação e a evolução do sistema de patentes no mundo foi movida por diversos fatores e interesses. Ao longo do tempo, diversos fatores influenciaram as modificações do sistema de patentes e as conformações que ele foi assumindo provocaram diversos questionamentos, inclusive sobre a pertinência do mesmo e a contribuição que ele poderia trazer para as nações usuárias. A função social da propriedade intelectual, prevista na Constituição da República Federativa do Brasil, indica que as patentes têm, como finalidade, atender ao interesse social e o desenvolvimento tecnológico e econômico do país. Nesse sentido, torna-se essencial a avaliação do cumprimento desses objetivos. O panorama atual permite avaliar os principais desafios pelos quais o sistema de patentes passa nos dias de hoje e também permite avaliar o desempenho das grandes nações em relação à utilização do sistema de patentes e inferir alguns dos aspectos em que o Brasil deve investir para se beneficiar muito mais do sistema. |
| Abstract: | The creation and evolution of the patent system in the world has been driven by several factors and interests. Over time, several factors influenced the modifications of the patent system and the conformations that he was adopting caused many questions, including of the relevance of it and the contribution that he could bring to the users nations. The social function of intellectual property under the Constitution of the Federative Republic of Brazil, indicates that patents have, as purpose, serve the social interest and technological and economic development of the country. In this sense, it is essential to the evaluation of compliance of these goals. The current situation allows us to assess the main challenges for which the patent system passes these days and also allows to evaluate the performance of the great nations in relation to the use of the patent system and to infer some of the aspects in which Brazil should invest to take more advantage of the system. |
