| Abstract: | A presente pesquisa pretende examinar, em Michel Foucault, três diferentes articulações do direito, de modo a associá-las com as concepções de disciplina, de biopolítica, de poder e de verdade e a forma como tais elementos foram decisivos em invenções e estratégias do biopoder. Assim, será evidenciado que o direito, para o autor, deve ser entendido não como restrito à lei ou a teorias da ciência jurídica, mas como um emaranhado de estratégias, de discursos e de jogos de relações, permeados pelo poder, os quais vão além do legalismo repressivo. Tendo em vista que o direito assume diferentes articulações no pensamento do filósofo, a investigação irá abalizar: 1) o direito como práticas judiciárias, que decorre das relações de poder entremeadas por elementos de verdade; 2) o direito como instância global soberana e dissimuladora das estratégias disciplinares de poder, poder que pode se traduzir em lei e norma; 3) o direito como forma de dominação local e normativa, em estratégias biopolíticas globais. Sendo o campo jurídico permeado por relações de dominação, a análise irá se articular com a temática dos regimes de verdade dos saberes, situando o direito como campo permeado pelo poder-verdade, como aquilo que se tangencia pelo poder disciplinar e pelas teorias soberanas e como um conjunto de técnicas biopolíticas na governamentalidade. |
| Abstract: | The present research attempt to exam, in Michel Foucaults thought, three different articulations of the Law, in order to associate them with the concepts of discipline, biopolitics, Power and truth and the way that these elements were decisive in inventions and biopower strategies. Thus, it will evidence that the law for the author should be understood not as restricted to law or legal theories, but as a tangle of strategies, speeches and relationships, permeated by power, beyond the repressive legalism. Considering that the right has different joints at the thought of the philosopher, the research will evidence: 1) the right as judicial practices arising from the power relations interspersed with elements of truth; 2) the right as a sovereign global instance that mask the disciplinary strategies of power, which can be translated into law and norm; 3) the right as local forms of domination and rules in the global biopolitical strategies. Considering that the juridical field is permeated by relations of domination, the analysis will articulate the theme of the knowledge of the truth regimes, placing the right as a field permeates by the power-truth, as what touches the disciplinary power and the sovereign theories and as a set of techniques in biopolitical governamentality. |
