| Title: | Regime diferenciado de contratações: uma análise de contratos em uma empresa pública |

| Abstract: | O modelo tradicional de contratações públicas, normatizado pela Lei Geral de Licitações LGL - é objeto de críticas. A administração pública se viu diante de desafios que envolviam ações para melhoria da sua infraestrutura, tendo em vista que o Brasil foi escolhido como país sede de eventos esportivos mundiais de destaque nos anos de 2013, 2014 e 2016. O Regime Diferenciado de Contratações Públicas RDC - foi criado com a finalidade de trazer eficiência às contratações públicas e com o objetivo principal de viabilizar, em tempo hábil, a implementação da infraestrutura necessária para a realização desses eventos. O presente trabalho, de abordagem empírica, exploratória e qualitativa teve como objetivo geral verificar se o RDC foi mais eficiente para a Infraero se comparado à LGL, inclusive no que tange aos contratos celebrados e, se poderia ser uma forma de licitação substituta à da LGL, deixando de ser exclusivo para eventos específicos. O trabalho utilizou o estudo de caso como estratégia de pesquisa. A unidade de análise é o RDC na Infraero e para atender ao objetivo proposto de verificar a eficiência desse novo regime de contratação para essa empresa pública, duas de suas licitações e respectivos contratos foram analisados. Utilizou-se também de entrevistas, observação participante e análise documental na Infraero e entrevista em um Tribunal de Contas, órgão de controle externo. Como parte da metodologia, criou-se simulações com o objetivo de verificar se a substituição de uma forma de licitação pela outra traz redução do tempo de licitação. Foi verificada, por meio das simulações, que a licitação por meio do RDC é mais ágil do que a licitação por LGL. O tempo gasto pelas comissões de licitação também é menor quando a licitação é feita por RDC. Em relação aos contratos, o decorrente da Concorrência não foi exequível, não foi executado dentro do prazo contratual e está paralisado. Caso seja retomado, haverá um aumento de mais de 20% no valor do contrato, que já havia sido reajustado em quase 7% do valor inicial contratado. O decorrente do RDC pode ser considerado exequível, não foi aditado e os seus serviços foram prestados até o final da execução contratual dentro do prazo estabelecido. Percebeu-se que em relação à fiscalização contratual não há mudança no RDC e que a opinião do órgão externo de controle é diferente da opinião da Infraero em relação ao estágio de desenvolvimento do RDC, principalmente quanto aos contratos. |
| Abstract: | The traditional model of public procurement, regulated by the General Law of Bids - LGL - is criticized. The government was faced with challenges involving actions to improve its infrastructure, given that Brazil was chosen as a country leading global sporting events established in the years 2013, 2014 and 2016. The Differentiated Regime of Public Procurement - RDC - was created in order to bring speed and efficiency to public contracts and with the main objective of enabling, in a timely manner, the implementation of the necessary infrastructure for carrying out such events. This work, empirical, exploratory and qualitative approach aimed to verify that the RDC was more efficient to Infraero compared to LGL, including with regard to contracts and could be a way to substitute bid to LGL, no longer exclusive to specific events. The study used the case study as a research strategy. The unit of analysis is the RDC in Infraero and to meet the proposed objective to verify the efficiency of this new procurement regime to that public company, two of its bids and contracts were analyzed. We also used interviews, participant observation and document analysis in Infraero and interview in a Court of Auditors, external control body. As part of the methodology, it was created simulations in order to verify that the replacement of one form of bidding by the other brings reduction of the bidding time. It was verified, through simulations, that the bid by the RDC is more responsive than the bid by LGL. The time spent by the bidding committee is also lower when the bid is made by RDC. For contracts, the result of the competition was not feasible, it was not executed within the contractual term and is paralyzed. If resumed, there will be an increase of over 20% in contract value, which had been adjusted by nearly 7% of the contracted initial value. The result of the RDC can be considered feasible, it was not added and its services were provided by the end of the contract execution within the deadline. It was noticed that in connection with contract oversight there is no change in the DRC and the opinion of the external body control is different from the opinion of Infraero in relation to their stage of development, especially for contracts. |
