Abstract: | Nesta dissertação é analisada a Propriedade Intelectual e a Transferência de Tecnologia no âmbito da Organização Mundial do Comércio (OMC) com o intuito de determinar as consequências da sua regulamentação dentro dessa organização para os países em desenvolvimento. Serão apresentados os aspectos gerais e os antecedentes da Propriedade Intelectual e do Direito da Concorrência, considerando as vantagens ou não da sua regulamentação dentro da esfera da OMC. Dado que o Acordo sobre Aspectos dos Direitos de Propriedade Intelectual Relacionados ao Comércio (TRIPS) estabelece como um dos seus objetivos que a proteção e aplicação das normas de propriedade intelectual devem fomentar a Transferência e a difusão de Tecnologia, será analisado se este objetivo vem sendo alcançado, avaliando tanto a regulamentação da transferência de tecnologia, como os principais indicadores dos fluxos internacionais de tecnologia, o qual permitirá determinar a participação mundial dos países em desenvolvimento, tanto na geração de direitos de propriedade intelectual, como na transferência internacional de tecnologia. |
Abstract: | This dissertation analyzed the Intellectual Property and Technology Transfer within the World Trade Organization (WTO) in order to determine the consequences of regulation within that organization for developing countries. The general aspects and the history of Intellectual Property and Competition Law will be presented considering the advantages or otherwise of its regulation within the WTO sphere. Since the Agreement on Aspects of Intellectual Property Rights Related to Trade (TRIPs) establishes as one of its objectives that the protection and enforcement of intellectual property rules should encourage the transfer and dissemination of technology, it will be examined whether this goal has been achieved, evaluating both the regulation of technology transfer, as key indicators of international technology flows, which will help identify the global participation of developing countries in both the generation of intellectual property rights, and the international transfer of technology. |
