Abstract: | Desde que a proposta de uma Declaração Universal de Direitos Humanos, ao fim da Segunda Guerra Mundial, foi formulada no âmbito das Nações Unidas, há um amplo debate político e acadêmico acerca da pertinência de falar em direitos universais. Controvérsias acerca da universalidade deste documento fizeram com que alguns posicionamentos relativistas se destacassem desde então. Alinhada a este esforço de relativização da suposta validade universal da Declaração da ONU está a Declaração de Direitos do Homem no Islã: documento assinado por diversos países do mundo muçulmano em que a ONU atua em defesa dos Direitos Humanos. Esta pesquisa examina o modo com que a ONU, por meio da atuação do Alto Comissário das Nações Unidas para Direitos Humanos e de seu Escritório (ACNUDH/EACNUDH) nesses países, lida com questões de relativismo cultural no que diz respeito aos direitos de liberdade de expressão e de religião, especificamente. |
Abstract: | Since the proposal for a Universal Declaration of Human Rights was formulated at the United Nations by the end of the Second World War, there is a broad political and academic debate about the suitability of speaking in universal rights. Controversies about the universality of this document caused some relativist positions to stand out since then. In line with this attempt to relativize the supposed universal validity of the UN Declaration, there is the Human Rights Declaration in Islam: document signed by several countries of the Muslim world in which the UN acts in defense of human rights. This research examines the way in which the UN, through the work of The United Nations High Commissioner for Human Rights and its Office (UNHCHR /OHCHR) in these countries, deals with cultural relativism issues concerning the rights of freedom, of expression and of religion, specifically. |
