| Abstract: | Este estudo busca investigar, sob a perspectiva dos adolescentes em cumprimento, a medida socioeducativa de internação. Para isso, procuramos identificar, a partir da fala dos adolescentes, o que tem sido possível ofertar ao longo da execução dessa medida, se o espaço da medida possibilita uma saída, não nos moldes idealizados, mas se é possível uma reflexão sobre a prática, permitindo assim, uma escolha mais consciente. Foram realizadas entrevistas com adolescentes em duas unidades socioeducativas de Belo Horizonte. Discutimos neste trabalho o conceito de socioeducação, o arcabouço legal relacionado à responsabilização penal juvenil, a criminalização de parcelas específicas da população, a medida socioeducativa de internação por tempo indeterminado e os impasses para a concretização dos eixos propostos. Tal discussão constitui o plano de fundo sobre o qual procuramos ouvir os adolescentes para saber deles como vivenciam a experiência de privação de liberdade. A partir dos resultados obtidos, foi possível identificar a dificuldade dos adolescentes em fazer uma análise crítica sobre a condição de privação da liberdade e, também, a dificuldade de subjetivação desses sujeitos que, em muitos momentos, repetem um discurso institucionalizado. Os achados desta pesquisa apontam um distanciamento entre o que está preconizado na legislação especial e a realidade vivenciada nas instituições. Apesar dos avanços, as instituições de privação de liberdade ainda são espaços onde as ações punitivas, muitas vezes, se sobrepõem às ações socioeducativas, repetindo a violência vivida por estes jovens em outros espaços. Consideramos que a o enfrentamento da violência exige a construção de ações conjuntas envolvendo diferentes atores e setores do Estado e da sociedade civil, com o objetivo de implementar efetivamente uma rede de proteção que alcance as condições de vulnerabilidade em que se encontram grandes parcelas da população, em especial, nossas crianças e jovens. |
| Abstract: | This study aims to investigate, fromthe perspective of adolescents in compliance, the socioeducational measure of commitment. For this purpose, we tried to identify, from the adolescents' speech, what has been possible to offer throughout the execution of this measure, if the space of the measure allows an "exit", not in the idealized patterns, but if a reflection on the practice is possible, thus allowing a more conscious choice. Interviews with adolescents were conducted in two socio-educational units of Belo Horizonte. In this work, we discussed the concept of socioeducation, the legal framework related to the juvenile criminal liability, the criminalization of specific portion of population, the socio-educational measure of commitment for an indeterminate period of time and the obstacles for the accomplishment of the proposed axes. Such discussion constitutes the background on which we seek to listen to the adolescents in order to know how they experience the deprivation of liberty. From the results obtained, it was possible to identify the difficulty of the adolescents to provide a critical analysis about the condition of deprivation of liberty, as well as the difficulty of subjectivation of these subjects that in several moments repeat an institutionalized speech. The findings of this research point to a gap between what is advocated in the special legislation and the reality experienced in the institutions. Despite the advances, deprivation of liberty institutions are still spaces where punitive actions often overlap socio-educational actions, repeating the violence experienced by these young people in other spaces. We consider that confronting violence demands the construction of joint actions involving different actors and sectors of the State and civil society, with the objective of effectively implementing a protection network that reaches the vulnerability conditions in which large portions of the population are found, specially our children and young people. |
