| Abstract: | Esta pesquisa discute a implementação do sistema de jurados no Brasil ocorrida nas primeiras décadas do século XIX. A época reportada (1823-1841) situa-se em um momento transicional e, portanto, de experimentação de novas formas organizativas, quando instituições incipientes buscavam se consolidar. Entre elas, o foco desse trabalho: a novidade do julgamento pelos pares que, apesar de originar-se com competência limitada, foi garantida como direito constitucional (1824) e regulamentada com jurisdição ampliada pelo primeiro Código de Processos Brasileiro (1832). O tema foi abordado a partir de dois fios condutores que são complementares: o primeiro privilegia o processo político legal de ampliação da competência do júri ao julgamento de todos os crimes e o segundo, o modo como o corpo de jurados se constituiu socioeconomicamente e atuou numa comunidade particular, o Termo da Vila de São José del-Rei. |
| Abstract: | This research discusses the implementation of the jury system in Brazil occurred in the first decades of the nineteenth century. The reported time (1823-1841) stands at a transitional moment, and therefore to experiment with new organizational forms, when fledgling institutions seeking to consolidate. Among this transition, the focus of this work: the novelty of peer review that although originate with limited powers, has been guaranteed as a constitutional right (1824) and regulated by the expanding jurisdiction with the first Brazilian Code of Procedures (1832). The topic was approached from two strands that are complementary: the first focuses on the political process of expanding the legal powers of the jury trial of all crimes, and second, how the jury constituted a socioeconomically and served community particular, the so-called Term of the town São José del-Rei. |
