dc.description.abstractThe Brazilian civil process, within the litigation, in cases in which the plaintiff asks for effective legal protection of urgency about the disputed object, allows the judge to utter interlocutory decision without hearing the defendant, in situations where according to the legal requirements, subjectives and objectives, there is a risk of irreparable harm to the plaintiff, or a hard harm. What justifies and therefore legitimizes the solitary decision of the judge, without the immediate opportunity to contradictory to the litigators, is the mismatch between the time and the form for the manifestation of the defendant and on the other hand, the safety of the legal asset in litigation, as a precaution to ensuring the effectivity of the final decision, or also as a way to satisfaction of a right to interrupt or prevent, in favor of the plaintiff, the risk of irreparable harm to the plaintiff, or a hard harm. However, over a long time and many theoretical constructs - especially about the constitutional nature of the process - we made a choice of a suitable process to democracy, in which citizens could, through the expression of their opinions, the exercise of their rights and legal satisfaction of their wants, with responsibility, define their way of life and destiny. In this context, an arbitrary decision, which impose to the litigants in the process the volition of an third person who is alien to their consciences, may conflict with the exercise of those in the process of their fundamental due process rights, contradictory, full efense and equality, to culminate in the obstruction of the democracy within one of the republican powers. Moreover, in urgency situations, provide to the defendant the form and the time designed to his manifestation, and more than that, to his integration into the process by the full exercise of their rights to full defense, to contradictory and equality, may imply the impossibility of the right of action of the plaintiff, also essential, as well as the obliteration of the object of action whose right is exercised. While it is notorious the procedural dilemma currently faced by the subjects of the process, between ensure one or another fundamental right - has long overcome by the doctrine in favor of the plaintiff - the possibility of simultaneous and effective guarantee of the right of action of the plaintiff, the litigators right to contradictory, full defense and equality, and to the material right in dispute, implies in flagrant violation of due process when uttered interlocutory decisions without hearing the defendant.pt_BR
dc.description.resumoO processo civil brasileiro, no âmbito do litígio, nos casos em que o autor pede por uma tutela de urgência sobre o objeto litigioso, permite ao juiz o proferimento de decisão interlocutória sem a oitiva do réu, nas hipóteses em que, segundo o cumprimento de requisitos legais objetivos e subjetivos, houver, essencialmente, risco de dano irreparável ou de difícil reparação ao bem da vida. O que justifica e, pois, legitima a atuação solitária do juiz, sem a imediata oportunidade de contraditório às partes, é a incompatibilidade entre o tempo e a forma para a manifestação do réu e a garantia de incolumidade do bem jurídico em litígio, como meio cautelar de garantia de efetividade do provimento final (sentença), ou, também, como maneira antecipatória de satisfação de um direito para a interrupção ou prevenção, em favor do autor, de dano irreparável ou de difícil reparação. Todavia, ao longo de muito tempo e de muitas construções teóricas especialmente sobre a natureza constitucional do processo , fizemos a escolha por um processoadequado à democracia, em que os cidadãos, mediante a expressão de suas opiniões, o exercício dos seus direitos e a satisfação legal das suas vontades, com responsabilidade, definem o seu modo de vida e o seu destino. Neste contexto, uma decisão arbitrária, que impõe às partes do processo a volição de um terceiro alheio às suas consciências, pode conflitar com o exercício daquelas, no processo, dosseus direitos fundamentais ao devido processo legal, ao contraditório, à ampla defesa e à isonomia, de modo a culminar no impedimento, no âmbito de um dos poderes republicanos, da democracia. Por outro lado, nas situações de urgência, proporcionar ao réu a forma e o tempo previstos para a sua manifestação e, mais que isso, para a sua integração à lide mediante o exercício pleno dos seus direitos àampla defesa, ao contraditório e à isonomia, pode implicar na inviabilidade do direito de ação do autor, igualmente fundamental, bem como na obliteração do próprio objeto da ação cujo direito é exercido, constituinte do que chama a doutrina bem da vida. Conquanto seja notório o dilema processual correntemente enfrentado pelossujeitos do processo, entre garantir um ou outro direito fundamental há muito superado pela doutrina a favor do autor a possibilidade de garantia simultânea e eficaz do direito de ação do autor, do direito das partes ao contraditório, à ampla defesa e à isonomia, e do bem da vida, implica em flagrante violação do devido processo legal quando proferidas decisões interlocutórias inaudita altera parte.pt_BR
