| Abstract: | O presente trabalho tem por escopo avaliar as bases em que foram alicerçadas a Constituição Imperial de 1824, contextualizando-a de forma a problematizá-la em suas origens liberais, permitindo-nos fazer uma leitura aberta e crítica da historicidade dos conceitos jurídicos brasileiros. Para tanto faremos uma sucinta comparação entre a ilustração europeia e a brasileira, principalmente por intermédio das discussões da Assembleia Constituinte de 1823, refletindo a forma com que esse ideal foi assimilado no Brasil de maneira a influenciar na mente da elite política brasileira, em especial a família Andrada e a icônica figura de José Bonifácio de Andrada e Silva. Avaliaremos a repercussão do liberalismo brasileiro na Independência, na formatação da identidade brasileira e na construção do Estado Nacional, passando tais conceitos pela relevante contribuição de José Bonifácio. |
| Abstract: | The present work has the purpose to evaluate the foundations on which were based the Imperial Constitution of 1824, contextualizing it in order to problematize it in its liberal origins, allowing us to make an open and critical reading of the historicity of the Brazilian legal concepts. For this we will make a brief comparison between European and Brazilian illustration, mainly through the discussions of the Constituent Assembly of 1823, reflecting the way that this ideal was assimilated in Brazil in order to influence the mind of the Brazilian political elite, especially the family Andrada and iconic figure of Jose Bonifacio de Andrada e Silva. We will evaluate the impact of liberalism in Brazilian Independence, the formatting of Brazilian identity and the construction of the National State, through such concepts by the relevant contribution of Jose Bonifacio. |
