Abstract: Esta tese se propõe a caracterizar a singularidade do processo da Justiça de Transição no Brasil e explicar as razões da incorporação tardia, lenta e parcial dos mecanismos da Justiça de Transição comissões da verdade, processos judiciais, reforma das instituições violadoras, políticas públicas de reparação e de resgate da memória na confrontação do legado de graves violações aos direitos humanos perpetradas pelo aparato repressivo da ditadura militar (1964-1985). Para ressaltar as especificidades do caso brasileiro, utiliza-se um trabalho comparativo controlado com as transições democráticas e as dinâmicas de Justiça de Transição produzidas nos países da região do Cone Sul. No sentido de compreender as razões dessa singularidade, foi necessário um duplo trabalho: de constituir e sedimentar a cultura internacional da Justiça de Transição e de construir uma narrativa histórica, a partir da gramática da Justiça de Transição, da transição da ditadura para a democracia até o final do segundo governo Lula, em 2010. Na construção dessa narrativa, buscou-se identificar e hierarquizar as variáveis que condicionaram o ajuste de contas (settling accounts) com o passado recente e os impasses que permeiam o enfrentamento dessa herança de violência estatal. O argumento central é que o caráter liberal-conservador da transição democrática influenciou a ausência de medidas de verdade e justiça no período da mudança de regime político, assim como o padrão da Justiça de Transição, centrado nas medidas de reparação, adotado pelo Estado brasileiro. Prevaleceu a hegemonia de uma transição conservadora, de não ruptura com o passado ditatorial, negociada por atores políticos comprometidos com os princípios de impunidade e esquecimento dos crimes da ditadura expressos na Lei da Anistia (1979). Contudo, esta variável não possui um caráter determinístico, pois consideramos que a singularidade da Justiça de Transição é influenciada por outros elementos, tais como a disputa de legitimidade democrática das narrativas construídas pelos atores políticos e sociais sobre o passado ditatorial, a baixa mobilização social em torno da temática do legado de violência do regime militar e o padrão judicializado da repressão política no Brasil. Do ponto de vista teórico, a tese discute o repertório teórico-conceitual da Justiça de Transição, a formação e desenvolvimento do campo, a influência do Direito Internacional dos Direitos Humanos (DIDH) e das organizações internacionais (governamentais e não governamentais) na sua difusão dessa perspectiva a partir dos anos 90. Ademais, a tese recupera e discute criticamente os estudos pioneiros sobre transições para a democracia (a transitologia), ressaltando as limitações desse paradigma teórico para a análise das formas de enfrentamento do legado de violações de direitos humanos de regime ditatoriais por meio dos mecanismos da Justiça de Transição.
Abstract: This thesis seeks to outline the singularities of the process of Transitional Justice in Brazil and explain the reason for the slow, late and partial incorporation of mechanisms of Transitional Justice truth commissions, judicial processes, institutional reform, reparations policies and memory initiatives for confronting the legacy of severe human rights violations perpetrated by the repressive apparatus of the military dictatorship (1964-1985). In order to highlight the specificities of the Brazilian case, the study is comparative and looks to the democratic transitions and dynamics of Transitional Justice produced in countries in the Global South. Understanding the reasons for this singularity led to a dual path in this study: a discussion and consolidation of our understanding of the international culture of Transitional Justice and based on the grammar of Transitional Justice, a composition of a historical narrative on the transition from dictatorship to democracy until the end of Lulas second term in 2010. While working on this narrative, the study looked to identify and rank variables that conditioned the settling of accounts with the recent past and the obstacles that permeate the confrontation of this legacy of state violence. The central argument is that the liberal-conservative character of democratic transition influenced the lack of truth and justice measures during the change in political regimes, as well as the pattern set for Transitional Justice, which was centered on reparation measures adopted by the Brazilian state. The hegemony of a conservative transition prevailed, which was one without a rupture with the dictatorial past, having been negotiated by political actors engaged with the principles of impunity and a failure to recognize the crimes committed by the dictatorship as expressed in the Amnesty Law of 1979. Nevertheless, this variable does not have a deterministic characteristic, since we considered that the singularity of Transitional Justice is influenced by other elements, such as the dispute over democratic legitimacy regarding the narratives on the dictatorial past created by political and social actors, low social mobilization regarding the issue of the legacy of the military regimes violence, and judicialized of political repression in Brazil. From a theoretical standpoint, the thesis discusses the theoretical-conceptual frameworks on Transitional Justice, the formation and development of the field of study, and the influence of International Human Rights Law and international organizations (governmental and non-governmental) in the diffusion of this perspective from the 1990s onward. Furthermore, this thesis recovers and critically discusses the pioneer studies on transitions to democracy (transitology), emphasizing the limitations of this theoretical framework for analyzing the ways of confronting the legacy of human rights violations in dictatorial regimes through mechanisms of Transitional Justice.
