Resumo
O presente trabalho objetiva enfrentar a discussão sobre a eticidade e juridicidade que permeia a relação travada entre humanos e animais, almejando a superação das discussões que hodiernamente se postam entre os vieses bem-estaristas e abolicionistas. Para tanto, partiu-se da busca pela definição de como os animais devem ser analisados, por meio da superação do dualismo cartesiano que dicotomizou animais e seres humanos em dois polos intransponíveis e incomunicáveis. Por meio de uma releitura da tradição ocidental no que tange à justeza devida ao tratamento dos animais, o trabalho demonstrou que evidências científicas colocam por terra o modelo cartesiano de explicação da relação entre humanos e animais. Na busca pela adequabilidade da eticidade e do direito devido aos animais, a partir da ruptura com a tradição dualista, abordou-se as principais respostas ético-jurídicas em voga no que diz respeito ao tratamento dos animais e do exato caráter da relação entre estes e humanos. Ao final, pôde-se evidenciar que os recortes em voga atualmente são insuficientes para que a questão que gira em torno da relação entre humanos e animais seja propriamente endereçada, tendo em vista o caráter sistêmico-emergentista que permeia tanto a caracterização daquilo que vem a ser um animal quanto das relações travadas entre animais, humanos e o ambiente circundante. Nesse sentido, propõe-se uma nova leitura da relação entre humanos e animais a partir da teoria dos sistemas emergentes.
Abstract
This paper aims to confront the discussion of the ethics and laws, which pervades the relationship between humans and animals, intending to overcome the current debates between welfarist and abolitionist biases. Therefore, the starting point was the search for definition of how animals should be examined by means of exceeding the Cartesian dualism that dichotomised humans and animals into impassable and incommunicable domains. Through a new reading of the Western tradition regarding fairness towards the ethical and legal treatment of animals, the paper aimed to demonstrate that scientific evidences debunk the Cartesian way of explaining the relationship between humans and animals. In the search for suitability of ethics and Law due to animals, from the rupture with the dualistic tradition, we analysed the primary ethical and legal responses in vogue regarding the treatment of animals and the exact nature of the relationship between these and humans. At the end, we could determine that the frames in vogue are currently insufficient in order to properly address the relationship between humans and animals, given the systemic-emergent character that permeates both the characterisation of animals and the relationship waged between animals, humans and the environment. In that direction, a new scope is proposed to analyse the relationship between humans and animals under the emergent systems theorys concept.
