Resumo
A presente dissertação tem como objeto de estudo a hermenêutica e a interpretação do Direito. O objetivo principal da pesquisa é investigar a possibilidade ou viabilidade de um método de interpretação do Direito que sirva para indicar um resultado singular em conformidade com o próprio Direito ou com o que aqui se chama de justiça do Direito positivo. Para conseguir alcançar o objetivo, foi percorrido um caminho através da técnica de revisão bibliográfica e a partir da hermenêutica filosófica de Hans-Georg Gadamer (em especial, o que ele desenvolveu em Verdade
e Método I) como referencial teórico principal. Por fim, concluiu-se, a partir da perspectiva teórica aqui adotada, que não há a possibilidade de criação desse método.
Abstract
The present dissertation has as object of study hermeneutics and the interpretation of Law. The main objective of the research is to investigate the possibility or viability of a method of interpreting the Law that serves to indicate a singular result in accordance with the Law itself or with what is called here the justice of the positive Law. In order to achieve the objective, a path was taken through the bibliographic review technique and from the philosophical hermeneutics of Hans-Georg Gadamer (in particular, what he developed in Truth and Method I) as the main theoretical reference. Finally, it was concluded, from the theoretical perspective adopted here, that there is no possibility of creating this method.
