dc.description.abstractThis article analyzes the exercise of normative discretionary competence by the National Land Transport Agency ("ANTT") and discusses how has been the control of such acts by the Judiciary. In order to elaborate the work and adopted the dogmatic-juridical methodological aspect, since it emphasizes the normative, conceptual and doctrinal aspects about the normative discretionary power of the ANTT. It is a theoretical research, culminating in the analysis of norms, doctrinal texts and opinions, as well as the analysis of the judgments of the Regional Federal Courts and the Superior Court of Justice on the subject. It concludes that there is no effective control of the Judiciary in normative discretionary acts of ANTT.

local.description.resumoO presente artigo analisa o exercício da competência discricionária normativa pela Agência Nacional de Transportes Terrestres (“ANTT”) e discorre sobre como tem sido o controle de tais atos pelo Poder Judiciário. Para elaboração do trabalho adotou-se a vertente metodológica dogmático-jurídica, uma vez que esta acentua os aspectos normativos, conceituais e doutrinários sobre o poder normativo discricionário da ANTT. Trata-se de pesquisa teórica, que culminou na análise de normas, textos doutrinário, pareceres e no exame dos julgados dos Tribunais Federais Regionais e do Superior Tribunal de Justiça sobre o tema. Conclui-se que não existe controle efetivo do Judiciário nos atos discricionários normativos da ANTT.
