A Audiência de Fortalecimento e a desestruturação da violência doméstica e familiar contra a mulher: uma análise do potencial transformador da fala da vítima

Abstract

The Law 11.340/2006 (Maria da Penha Law) represents a mark in the efforts to combat domestic and family violence against women in Brazil, as it seeks to break with the gender order that keeps the female population in a vulnerable situation. In recent years, several projects have emerged in the Judiciary to make the law more effective. The present research seeks to investigate and present the fundamentals of the Strengthening Hearing - a type of hearing created in 2017 by the 14th Court of Domestic and Family Violence against Women of Belo Horizonte and which allows the victim to speak, in front of the aggressor, about the violence suffered in the relationship and their need to break free from that situation, while the man should just listen to what she has to say. The research sought to find out if the act analyzed is, in fact, efficient to contribute to ending the cycle of domestic violence and, if so, by what mechanisms. Rita Laura Segato's theory about the elementary structures of violence was used as a theoretical framework, focusing on the mandate of masculinity. As methodology, were used bibliographic research and field study, conducted from the analysis of judicial procedures, participant research and semi-structured interviews with women who participated in the act and with the judge who created of the hearing. The analysis of the object revealed, among other points, that the speech space granted to the victim in the hearing is able to modify the situation of violence experienced by her and that the profile and posture of the magistrate are decisive for this.
