Resumo
O presente trabalho apresenta um estudo acerca da relação entre a retórica jesuítica e os discursos jurídicos atuais, especificamente, o vocabulário usado em sentenças judiciais. Como objetivo geral, pretende verificar a (in) existência de características da retórica jesuítica em discursos jurídicos. Especificamente, busca evidenciar as implicações sociais do vocabulário empregado em sentenças judiciais no acesso efetivo à justiça. Trata-se de uma pesquisa bibliográfica, de cunho qualitativo. Conclui-se, a partir do trabalho, que o vocabulário afetado e pomposo, presente na retórica jesuítica e persistente na sociedade, sobretudo no texto jurídico,
compromete a efetivação da justiça.
Abstract
This work presents a study about the relationship between Jesuit rhetoric and current legal discourses, specifically, the vocabulary used in judicial sentences. As general and specific objectives, it intends to verify the (non) existence of characteristics of Jesuit rhetoric in legal discourses, as well as seeking to highlight the social implications of the vocabulary used in judicial sentences in effective access to justice. This is a qualitative and bibliographical research. It is concluded that the affected and pompous words, present in the Jesuit rhetoric and persistent in society, especially in the legal text, compromises the effectiveness of justice.
