Marx e Hegel: três momentos da crítica marxiana ao direito

Abstract

Here, we intent to show the Marxian itinerary, having as parameter three moments of the work of the author in what concerns the critic to the Right. The first moment constitutes a transition, in which the German author develops a critique of the Law that turns directly against Hegel and against great exponents of the political economy. The second moment appears before the prominence of Proudhon in the political scene. The author of the Philosophy of misery, insofar as it has the Right by center, can be seen, according to Marx, as an epigone of Hegel. Finally, we will bring to the fore Marx's position on two essential authors for the conformation of the "theory of law," J. Austin and J. Bentham. These authors, according to the author of Capital, acritically accept the vulgar economy, and are, thu,s a clear expression of the apology to the existing.
