A crítica marxista do direito diante de Friedrich Engels: a tensão entre exposição e pesquisa em sua análise da esfera jurídica

Abstract

Considering the Marxist critique of law, especially in its most sophisticated aspect, which follows Pachukanis´ tracks, we will analyze the criticism of Friedrich Engels of the legal sphere. Having a certain tension between exposure and research in Engels texts, we will see how the author of Anti-Dühring relates the capitalist circulation of commodities to law. Having accomplished this task, we try to bring the critics our author of the rational right and justice. This will prove how Engels' position is much more sophisticated than is normally supposed. We will note, however, that the risk of hasty readings of your texts is not exogenous to the way in which they are articulated. Finally, we will see how Engelsian criticism of law can still be very important for Marxist criticism.
