Paidéia jurídica: uma reflexão sobre a educação em direitos humanos-fundamentais

Abstract

It will be explored, in the course of this work, the Greek thought of the Paideia, in which the ethical development of the individual was the focus of his formation as a man / citizen. Starting on this Greek idea, it will be initially analyzed the philosophical contributions from leading thinkers that had addressed the issue, especially the Greek Socrates, Plato and Aristotle, so that we can reflect on the construction of a legal education in Human - Fundamental Rights, based on the model of paideia. To do so, the term Human - Fundamental Rights will be used, therefore, in regard to the dogmatic instrument of formation, one has to address both the level of international recognition of their rights as their positivation by the state; thats because theres education on fundamental human rights and for fundamental human rights. For such understanding, there will be presented a description about the historic achievement of fundamental rights in Brazil. It is proposed that this formation will occur through theuse of maieutics and dialectic, in a way that individuals can, starting on their prior knowledge, achieve awareness for citizenship . In order to get to these reflections, this work will use the teachings of contemporary authors such as Werner Jaeger, Joaquim Carlos Salgado, Mariah Brochado, Barbara Freitag, among others.Transdisciplinarity formed from the law, Pedagogy and Psychology is one of the path for the development of this action, in which the dialogue with authors such as Piaget, Vygotsky and Kohlberg left themselves indispensable. Thus, it will urge up for a philosophy of education in Human - Fundamental Rights, which, from this dialogue, the student can effectively achieve the legal awareness and civic education.
